If you read the comments to the post below, you will know that a band in Florida is calling themselves The Hold. When they signed up for Myspace, they would've been told that we already exist. It seems they don't care. They probably assume we're some hicks up in Nova Scotia, not that we have fans all over the world (or close to it), have just put out our third release, and have been reviewed in American magazines. Some people say it doesn't really matter. There were lots of other bands that had the same names as someone else. I think it does matter. What if fans of ours pick up albums or merch of theirs by mistake, or vice versa? Plus, warning: stereotyping ahead, Americans like to sue people, right? What if, sometime in the future, they see us as successful and decide to sue? It's not a concern right now, but it could be. They aren't selling records in Canada, so we can't say much yet, but we just sold some records to a distro in Maine...

I decided to try to get some information from them before worrying about any of the above. I took anything mentioning The Hold out of my profile, changed my Top 8 (if they clicked on Dog Day, they would see the Hold in their Top 8 and so on), added a song of theirs to my profile, and wrote them trying to sound like a fan.

Body: hey crystal. tony here from the hold. thanks for the add. i saw that you added forced by honor on your profile. that rules!!! to answer your questions, we have been around for 3 years but we have been plagued by drummer problems. a few months ago we solidified the line up with d.j. on drums and weve been playing nonstop since. we do have a recording with the 4 songs from the myspace site plus 2 more. hopefully soon we'll have a way to purchase our merch on our myspace site, but for now theyre only availible at the shows. thanks again for the add and the intrest. take care...

  • You might talk to D. Hiltz about it. I think there was another band called The Chitz back in the day and I think he considered copywriting the name in Canada, which apparently isn't a particularly difficult thing to do.

    I wouldn't worry about any big problems though. Geographically you're pretty far from each other. You were in a band called the Briefs, were you worried then?

  • Yeah, I don't know much about it, but I think it is actually easier than most people think. If we end up caring, I just might talk to Mr. Hiltz.

    I'm not particularly worried. We are geographically spread out. I guess my concern isn't that they're using the name and I want to fight them, but that they might want to sue us in the future. Based on his responses to my questions, though, I think we'd win since we've put out 3 albums dating back to early 2004 (recorded 2003).

    It's funny you mention the Briefs. No, we weren't worried then. But, I did press the issue at many practices and we had 2 band meetings to discuss changing our name. In the end, we couldn't come up with anything we liked, and we figured we wouldn't be touring and probably wouldn't release an album, and besides, "there were two Suckerpunches." It was mentioned that there were two Teen Idles (neglecting to point out they were spelled differently). We figured people in the city knew who we were, and we were doing it for fun, with no huge goals, and they were American anyway (just like this other hold). "Bush X" was just "Bush" everwhere but Canada.

    The Hold, on the other hand have released stuff and have toured.
